Japan Freak Terms of Use

The following terms of use (hereinafter referred to as "these Terms") are set forth for the use of "Japan Freak".

Article 1 (General Provisions)
1. These terms apply to our company and users with regard to the use of Japan Freak and this service. Users shall comply with these terms when using Japan Freak and this service.
2. Individual and additional provisions posted separately by our company on Japan Freak shall constitute part of these terms. In the event of a difference between these terms and these individual or additional provisions, the individual or additional provisions shall take precedence.
3. These terms may be unilaterally changed or abolished by Global Media Market (hereinafter referred to as "our company"), and users shall be deemed to have agreed to the change or abolition of these terms by the new terms being posted on Japan Freak.
4. Japan Freak is only available to those who make purchase applications from outside Japan and deliver products outside Japan. Purchase applications from within Japan and those who deliver products to within Japan are not permitted to use the service.

Article 2 (Definitions)
1. In these Terms and Conditions, the following terms shall have the meanings set forth below.
(1) "Japan Freak": A website operated by our company under the name "Japan Freak" on the Internet, a system with functions to provide services such as posting information on product offers, accepting and transmitting online applications for product offers, and accepting and transmitting complaints.
(2) "User": A person who accesses and uses "Japan Freak".
(3) "Service": A service set forth in Article 4 that our company provides to users through "Japan Freak".
(4) "Seller": A person who offers products on "Japan Freak".
(5) "Exhibition": An exhibitor offering a product on "Japan Freak".
(6) "Product": An item that a seller offers to "Japan Freak".
2. In these Terms and Conditions, unless otherwise specified, all times and dates are based on Japan time.
3. The headings of each article in these Terms are for convenience only and shall not affect the interpretation of these Terms. 4. Any citation to a provision shall refer to the provision of these Terms, unless otherwise specified.

Article 3 (Method of Notification from the Company to the User)
1. Unless otherwise specified in these Terms, notifications from the Company to the User shall be made by email to the email address entered by the User when using the Service, by posting on "Japan Freak", or by any other method deemed appropriate by the Company.
2. If the notification in the preceding paragraph is made by email, the Company will send the email to the server to which the User is affiliated, and the notification to the User will be deemed completed when the email arrives at the server.
3. If the notification in paragraph 1 is made by posting on the Mall, the notification to the User will be deemed completed two days after the notification is posted on "Japan Freak".

Article 4 (The Service)
1 The Service provided by our company through "Japan Freak" is as follows.
(1) Providing information on products offered by sellers on "Japan Freak" by region through an online electronic catalog
(2) Providing order and payment information for products from users to sellers
(3) Receiving and transmitting inquiries and complaints about products and sellers
2 Users shall use the Service only for personal use and shall not use "Japan Freak"
or the Service to conduct business.

Article 5 (Acceptance of Terms)
1. The User is deemed to have carefully read the Terms on the Japan Freak page, to understand their contents, and to have accepted these Terms.
2. The Company shall not be held liable for any disadvantage suffered by the User as a result of any errors or omissions in the information entered by the User on the Mall screen when using Japan Freak.

Article 6 (Refusal of Use)
If any of the following reasons apply to the user, the Company may refuse to allow the user to use "Japan Freak" or this service.
(1) The user does not exist
(2) The user has been refused use of "Japan Freak" in the past due to violation of these terms and conditions, etc.
(3) The information entered at the time of use contains falsehoods, errors, or omissions
(4) The user is unable to perform valid legal acts on his/her own
(5) For any other reason that the Company deems the user ineligible to be a user.

Article 7 (Handling of Personal Information)
1. The Company will handle information about users (hereinafter referred to as "personal information") appropriately in accordance with the "Personal Information Protection Policy" separately posted on the "Japan Freak" web page.
2. The Company will use personal information for the following purposes. In addition, the Company may entrust personal information to a contractor to the extent necessary for use.
(1) Operating "Japan Freak" or providing this service
(2) Displaying information about "Japan Freak" or this service that is deemed useful to each individual user on the web page accessed by the user, or sending it by e-mail or post. In addition, users may suspend or resume such use by notifying the Company.
(3) Sending e-mails to request consent to the use of personal information from users
(4) Using personal information within the scope of other consents obtained from users
3. The Company will not disclose or provide personal information to third parties unless the user consents after notifying them of the recipient and purpose of use of the personal information (including clearly indicating the recipient and purpose of use on the screen and providing the user with an opportunity to refuse). However, this does not apply in the following cases.
(1) If disclosure is required by law or order from a government agency, the Company may disclose personal information to the extent necessary.
(2) If the Company deems it necessary to identify, pay, or collect receivables and payables related to the user's use of the Mall or this Service, the Company may disclose personal information to store owners, credit card companies, financial institutions, etc. to the extent necessary.
4. The Company may use cookies to identify the user's device.
The Company will treat information on the user's usage of "Japan Freak" identified by a combination of cookies and the user's ID, etc., as personal information. 
5. We may collect and analyze the attributes of users' personal information, process it so that individuals cannot be identified or specified (hereinafter referred to as "statistical data"), and use it for the development of new services and other business operations. We may also provide such statistical data to business partners, etc.

Article 8 (Prohibited acts)
1. When using Japan Freak, users must not engage in any of the following acts:
(1) Using "Japan Freak" or this service for fraudulent purposes. (2)Any act that infringes or may infringe the copyright, trademark, or other rights of the company, exhibitors, or third parties. (3) Transmitting information by any means other than those specified by the company. (4) Falsifying information posted on "Japan Freak". (5) Sending or posting information (computer programs, etc.) other than that specified by the company. (6) Any act that interferes with the operation of "Japan Freak". (7) Any act that damages the reputation of the company, exhibitors, or other third parties, or interferes with their business. (8) Any act that publishes or posts information on "Japan Freak" that violates public order and morals (including, but not limited to, obscene or violent messages, graphics, audio, etc.). (9) Any other act that the company deems inappropriate. 2. The user who violates the preceding paragraph shall be responsible for the consequences of such violation, and the company shall not be held responsible in any way.

Article 9 (Suspension of operation of "Japan Freak")
1. The Company may suspend the operation of "Japan Freak" or all or a part of this service without prior notice to the user if any of the following events occur:
(1) Periodic or emergency maintenance or updates of the equipment or system for the operation of "Japan Freak" or the provision of this service are performed.
(2) War, terrorism, riots, disturbances, labor disputes, earthquakes, volcanic eruptions, floods, tsunamis, fires, power outages, or other force majeure make it difficult to provide this service.
(3) The services of a telecommunications carrier are not provided.
(4) Other operational or technical reasons require the Company to suspend or stop this service, or the Company determines that it is difficult to provide this service due to unforeseen circumstances.
2. The Company shall not be liable for any disadvantage or damage suffered by the user or a third party due to the occurrence of the temporary suspension or suspension of the provision of this service under the preceding paragraph, regardless of the reason.

Article 10 (Transactions with Exhibitors)
1. Products are provided at the exhibitor's own risk and are not provided or managed by our company or its affiliates. Users will transact directly with the exhibitor as the seller and the user as the buyer. Our company will not be held responsible for the success or failure of a transaction, defects in the product, delivery and receipt of the product, the success or failure of the contract related to the transaction (validity, cancellation, etc.), returns, after-sales service, or any other transactions conducted between exhibitors and users through the use of "Japan Freak".
2. All products and the content posted about the products are the responsibility of the exhibitor, and our company does not guarantee the accuracy, completeness, suitability for purpose, usefulness, etc. of the products and information about the products. Furthermore, our company does not guarantee the qualifications, supply ability, etc. of the exhibitor in selling the products.
3. Orders for products from exhibitors will be accepted when all the information on the order screen is received by our computer system. 4. Payment can only be made by credit card via PayPal. Payments will only be accepted from the postal address registered in your PayPal account, so please make sure your PayPal postal address is up to date. 5. As soon as we confirm the payment via PayPal, we will send a confirmation email to the user and pass on the order information received from the user to the seller. 6. After the seller confirms payment for the price and shipping fee, they will deliver the product to the user. Delivery will take several days. It may take up to ?days.

Article 11 (Complaint handling)
1. If the product does not arrive, the product that arrives is different from the one ordered, the product is defective, or for any other complaints, please use the inquiry form and telephone number provided by Japan Freak.
2. When you make an inquiry, we may ask you to provide documents in order to consider the content of your inquiry. In this case, if you do not provide the documents, we may not be able to respond to your inquiry.
3. Since the transaction regarding the product is concluded directly between the user and the seller, the seller bears all responsibility for the inquiry, and our company bears no responsibility whatsoever.

Article 12 (Cancellation of Contract)
1. The sales contract is concluded when the confirmation email in Article 10, Paragraph 5 is sent, and neither the user nor the seller can cancel the contract, except in the cases in the following paragraphs and the following article.
2. Notwithstanding the provisions of the preceding paragraph, the seller may cancel the contract through our company if the product is out of stock. If the contract is cancelled, our company will cancel the credit card payment, and if the payment has been processed, we will refund the money.
3. Notwithstanding the provisions of Paragraph 1, if the product has not arrived more than days after the conclusion of the sales contract, the user may cancel the contract by notifying our company. In this case, our company will cancel the credit card payment, and if the payment has been processed, we will refund the money.
4. How to cancel the contract

Article 13 (Returns)
1 If the delivered product is different from the ordered product or if the delivered product is defective, please contact us by email within 3 days of delivery, attaching a photo showing the specific circumstances and the condition of the product.
2 If we receive the email in the previous paragraph, we will inform you of the return address, so please return the product in the package used for delivery, along with the receipt or purchase certificate (you will be responsible for the shipping fee). We will review the returned product with the seller and inform you of the next steps. Please note that the re-shipping fee will be charged if we resend the product.
3 If you contact us to cancel your order, we will review the returned product with the seller and, if the circumstances for the return are confirmed, we will cancel the credit card payment and, if the payment has already been processed, we will process a refund.
4 Description of the tracking number, loss insurance, and product return
Please make sure to return the item with a tracking number, the product price, and a loss insurance service. Also, please make sure the return slip/invoice says "Product Return" in large letters.

Article 14 (Scope of Responsibility)
1. Except for transmitting the order information received from the user to the seller in a manner determined by the seller, the Company shall not be liable for the content of information regarding the products provided, the success or failure of the transaction contract related thereto, or its fulfillment.
2. The Company shall not be liable for whether the order information sent by the user arrives at the Company's computer system, or whether the order information that arrives at the Company's computer system is the same as the order information sent by the user.
3. If the order information that arrives at the Company's computer system from the user cannot be transferred to the seller due to reasons attributable to the Company, the Company shall only compensate for damages if there is intentional or gross negligence on the part of the Company.

Article 15 (Damage Compensation)
1. Except as otherwise provided, the Company shall not be liable for any damages incurred by users or third parties in connection with the provision, delay, change, interruption, suspension, or discontinuance of the Service, the loss or disappearance of information registered or provided through the Service, or any other damages incurred by users or third parties in connection with the Service.
2. If a user causes damages to a third party through the use of the Service, the user shall resolve the matter at his/her own responsibility and expense and shall not cause damages to the Company. If a user causes damages to the Company by violating these Terms and Conditions, the Company may claim appropriate compensation for damages from the user.

Article 16 (Abolition of the Mall)
The Company may abolish the Mall at any time.

Article 17 (Governing Law)
The governing law of these Terms shall be the laws of Japan.

Article 18 (Jurisdiction)
Any litigation relating to the use of the Mall or this Service or these Terms and Conditions shall be subject to the exclusive jurisdiction of the Tokyo
District Court as the court of first instance.
